2. No Guarantee of Outcomes

Results Not Guaranteed: While our AI tools are designed to identify potential service-connected disabilities, AiVAclaims.com does not guarantee any specific VA disability rating, benefit amount, or timeline. The Department of Veterans Affairs (VA) is the sole authority for determining benefit eligibility. Any "lifetime value" calculations provided on this site are estimates based on current VA pay tables and are for illustrative purposes only.

3. User Responsibility & Verification

Accuracy of Submissions: The User acknowledges that AI-generated content may contain inaccuracies or "hallucinations." The User assumes 100% responsibility for reviewing all generated documents (including Injury Statements and Nexus Letters) for accuracy and truthfulness before submitting them to the VA. Submitting false information to the federal government carries severe legal penalties; AiVAclaims.com shall not be held liable for any inaccuracies in user-submitted claims.

4. Limitation of Liability

Limitation of Damages: To the maximum extent permitted by law, AiVAclaims.com’s total liability for any claim arising out of our services shall be limited to the total amount paid by the User to AiVAclaims.com. In no event shall AiVAclaims.com be liable for "lost benefits," "expected future income," or any consequential damages resulting from a denied VA claim.

5. Compliance with 38 U.S.C. § 5904

Nature of Fees: The flat fee charged by AiVAclaims.com is for the use of proprietary data-analysis software and document-preparation tools only. This fee is not a "contingency fee" for the successful prosecution of a claim, nor is it a fee for legal representation.

6. Acceptance of Terms

By accessing or using AIVA Claims Assistant ("AIVA," "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

The Service, including its original content, features, and functionality, is owned by AIVA and is protected by copyright, trademark, and other intellectual property laws. Documents you create using the Service belong to you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the Service will result in approval of your VA claim or any specific rating.

10. Indemnification

You agree to indemnify and hold harmless AIVA from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your submission of materials to the VA.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
