Acceptance of Terms By accessing or using AIVA Claims Assistant ("AIVA," "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. ## 2. Description of Service AIVA is a technology platform that provides AI-powered tools to help you organize and prepare documents for your VA disability claim. Our Service includes: - AI analysis of medical records to identify potential conditions - Generation of draft injury statements, buddy letters, and nexus letters - Document organization and claim tracking tools - Educational resources about the VA claims process ## 3. Professional Services Disclaimer \**No Medical or Legal Advice:** AIVA Claims is a technology platform that uses artificial intelligence to help organize and analyze medical records. AIVA Claims is not a law firm, a medical provider, or a VA-accredited claims agent. Our AI-generated summaries, nexus letter drafts, and buddy letter drafts are templates intended for your review and, where appropriate, review by a licensed professional before you submit them to the VA. Use of this service does not create an attorney-client or doctor-patient relationship. ## 4. User Responsibility & Verification \**Accuracy of Submissions:** The User acknowledges that AI-generated content may contain inaccuracies or "hallucinations." The User assumes 100% responsibility for reviewing all generated documents (including Injury Statements and Nexus Letters) for accuracy and truthfulness before submitting them to the VA. Submitting false information to the federal government carries severe legal penalties; AIVA Claims shall not be held liable for any inaccuracies in user-submitted claims. ## 5. Compliance with 38 U.S.C. § 5904 \**No Fees.** AIVA Claims does not charge veterans for the use of this Service. AIVA is donor-funded, and access to our data-analysis software and document-preparation tools is provided at no cost to the veteran. We do not charge a "contingency fee," a percentage of any retroactive award, or any other fee tied to the outcome of a claim. \**Not Legal Representation.** Nothing in this Service constitutes legal representation, and AIVA Claims is not acting as your agent or attorney before the Department of Veterans Affairs. We do not prepare, present, or prosecute a claim on your behalf under 38 U.S.C. § 5904; you remain the claimant. For representation, veterans may work with a VA-accredited representative, including an accredited Veterans Service Organization, at no charge. ## 6. No Guarantee of Outcomes \**Results Not Guaranteed:** While our AI tools are designed to identify potential service-connected disabilities, AIVA Claims does not guarantee any specific VA disability rating, benefit amount, or timeline. The Department of Veterans Affairs (VA) is the sole authority for determining benefit eligibility. Any "lifetime value" calculations provided on this site are estimates based on current VA pay tables and are for illustrative purposes only. ## 7. Limitation of Liability \**Limitation of Damages:** To the maximum extent permitted by law, AIVA Claims’s total liability for any claim arising out of our services shall be limited to the total amount paid by the User to AIVA Claims. In no event shall AIVA Claims be liable for "lost benefits," "expected future income," or any consequential damages resulting from a denied VA claim. Veterans pay no fees, so the amount paid by a veteran may be $0. The limitation above applies only to the extent permitted by law. ## 8. Intellectual Property The Service, including its original content, features, and functionality, is owned by AIVA and is protected by copyright, trademark, and other intellectual property laws. Documents you create using the Service belong to you. ## 9. Disclaimer of Warranties THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not guarantee that the Service will result in approval of your VA claim or any specific rating. ## 10. Indemnification You agree to indemnify and hold harmless AIVA from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your submission of materials to the VA. ## 11. SMS / Text Messaging Program \**Program and sender.** AIVA Claims, a program of ESBE Incorporated, offers optional text-message updates about your account and your VA claim. Messages are sent by AIVA Claims. \**How to opt in.** You opt in by checking the unchecked text-message consent box on our [Text Updates](https://aivaclaims.com/text-updates) page, on a form that asks for your mobile number, or on a consent prompt inside your AIVA account. We do not send program texts to a number that has not opted in. \**What we send.** Account notifications, claim-status updates, appointment and consultation reminders, and replies from our support team. We do not send advertising or promotional texts on behalf of anyone else. - \**Message frequency varies.** - \**Message and data rates may apply.** - \**To cancel** — reply **STOP** to any message. You will receive one confirmation text and then no further messages. Opting out does not close your account or stop the email we send about your claim. - \**For help** — reply **HELP** to any message, or email [help@aivaclaims.com](mailto:help@aivaclaims.com). - Carriers are not liable for delayed or undelivered messages. \**Not a condition of service.** Agreeing to texts is never required to use AIVA or to get help with a claim. \**We will not share your opt-in data or consent with third parties.** How we handle your mobile number, and the messaging provider that delivers our texts, are described in the [SMS section of our Privacy Policy](https://aivaclaims.com/privacy#sms). ## 12. Termination We may terminate or suspend your account at any time for violation of these Terms. Regular veteran accounts can delete their account in Dashboard Resources using Delete Account. You can also request deletion by emailing help@aivaclaims.com. The [Privacy Policy](https://aivaclaims.com/privacy#deletion)explains immediate self-service deletion, emailed requests, retention requirements and administrator restrictions. Upon termination, your right to use the Service will cease immediately. ## 13. Changes to Terms We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of the Service after changes constitutes acceptance of the new Terms. ## 14. Governing Law These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. ## 15.
